After extensive drafting from community input, and the legal advice of Law Firm Rice & Rice, the following final configuration of The Landing’s Governing Documents are now presented for your consideration and vote in accordance with Texas Property Code 209.0041:

You are strongly encouraged to thoroughly review each document. Should you have any remaining questions, please seek clarification from the Vote Ballot Committee and/or the Board of Directors prior to casting your vote. Email questions to the office.

Significant resources have been expended to ensure these documents align with the current Texas Property Code, as well as addressing property values and homeowners’ property rights, by reinstating the “Delegation of Use” provision that was omitted from the original 1977 documents.

Please note that, apart from minor mechanical error corrections, such as spelling and punctuation, the only substantive revisions from the previously presented 2023 Declaration draft are the inclusion of the 'Delegation of Use Clause' in Article X and 'Leasing Restrictions' in Article XI, which include a 15% rental cap, prohibition of short-term rentals, and a sex offender restriction clause.

Your vote pertains to the documents in their entirety; individual sections may not be selectively approved or rejected.

To clarify any previous confusion, a vote “For indicates your approval of the final documents as presented, while a vote “Against indicates your disapproval of them.
